TESTIMONY


Since 1979, M. Patricia Fisher has qualified to testify in over 200+ court proceedings in both federal and state courts in addition to arbitrations, hearings and depositions. She is also a consulting expert and a former teacher who uses her teaching skills to educate the jury and the court about the document issues in the case.

EXHIBITS


Questioned documents are often resolved effectively with an illustrated report presenting the evidence in a convincing manner. Both sides can better evaluate the document evidence in a case before moving forward to trial. In the event the attorney decides it is better to wait until trial to provide testimony and exhibits, an effective presentation becomes even more critical. The following three cases show exhibits used successfully in two jury trials and one bench trial.
Questioned signatures in an elder abuse case
Two questioned signatures of the elder father were purportedly signed in the notary book. The extended lines from the signatures below obscured the questioned signatures. Enlarging the signatures using Adobe Photoshop® made it possible to remove the extraneous pixels and compare the handwriting characteristics.
Fabricated e-mails
The plaintiff submitted a series of questioned e-mails. Each of the e-mails proved to be a fabrication. The adjacent questioned e-mail shows two ways that the greater than symbols were misused. One shows the symbols are misplaced on the page and the other symbols overlap a name.
Altered medical records
A medical record provided by plaintiff in an insurance case contained a significant alteration. To reconcile the records, the number “8” was obscured with white-out and the number “4” written over the “8.” By making this change, the doctor could fill in the blank line below to request more money from the insurance company for a doctor’s visit that had not occurred.
